Limited Warranty

THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

PLUME DESIGN, INC., 325 LYTTON AVENUE, PALO ALTO, CA 94301 (PLUME OR WE) WARRANTS THAT DURING THE LIMITED WARRANTY PERIOD, THE SUPERPOD™ WI-FI EXTENDERS (PRODUCT)WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP FOR A PERIOD OF FIVE (5) YEARS AFTER THE DATE OF PURCHASE.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

1. TO WHOM THIS LIMITED WARRANTY IS EXTENDED

Plume Design, Inc. (Plume or we) located at 325 Lytton Avenue, Palo Alto, California 94301 U.S.A., offers this limited warranty only to the consumer who originally purchased the Product (you). It does not extend to any subsequent owner or other transferee of the Product.

2. WHAT THIS LIMITED WARRANTY COVERS

This limited warranty covers defects in materials and workmanship of the Product for the Limited Warranty Period (defined in Section 4. below).

3. WHAT THIS LIMITED WARRANTY DOES NOT COVER

This Limited Warranty does not cover the following:

  • Any Product marked as “sample” or “Not for Sale”, or sold “AS IS”
  • Any Product purchased from or received from any seller other than Plume or any other third party
  • Normal wear and tear
  • Damage caused by improper use, misuse or abuse of the Product
  • Failure to follow, or failure to use in accordance with, the User’s Guide, Placement Guidelines, or other instructions provided by Plume.
  • Damage caused by improper maintenance or repairs, unauthorized repairs or failure to perform any preventive maintenance
  • Any Product that was subject to modifications, alterations or defacing
  • Damage caused storage, installation or testing
  • Damage caused by breakdowns, fluctuations, or interruptions in electric power or the telecommunications network or other external causes (such as accidents, abuse) beyond our reasonable control.

4. PERIOD OF COVERAGE FOR THIS LIMITED WARRANTY

This Limited Warranty starts on the date of your purchase of the Product and lasts for the one (1) year; and if you maintain a continuous active subscription for membership to the HomePass Service or the WorkPass Service (Membership), the period of coverage is extended for the shorter of five (5) years and the date on which your Membership expires (Limited Warranty Period).

The Limited Warranty Period is not extended if we repair or replace the Product. We may change the availability of this Limited Warranty but changes will not apply retroactively.

5. YOUR REMEDIES UNDER THIS LIMITED WARRANTY

During the Limited Warranty Period, we will, in our sole discretion, repair or replace your Product (or the defective component) free of charge. We also will cover all shipping and handling fees to return the repaired or replacement Product to you.

Repair or replacement may be made with a new or refurbished Product or components, at Plume’s sole discretion. If the Product or a component of the Product is no longer available, Plume may, at Plume’s sole discretion, replace the Product with a similar product of similar function.

Any Product that was repaired or replaced under this Limited Warranty will be covered by the terms of this Limited Warranty for the remaining Limited Warranty Period and will not be extended or expanded.

6. HOW TO RECEIVE SERVICE IF YOU WANT TO MAKE A CLAIM UNDER THIS LIMITED WARRANTY

To obtain service under this Limited Warranty, you must notify Plume’s Support team by calling 1-844-697-5863, emailing [email protected] or visiting support.plume.com during the Limited Warranty Period and providing a description of the alleged defect.

Plume’s Support team will provide a warranty claim number and return delivery instructions.

Plume will reimburse any shipping costs incurred by you unless Plume determines that your Product is not covered by the Limited Warranty, as described in Section 3 above, or if you make your claim after the expiration of the applicable Warranty Period.

7. YOUR RIGHTS AND THIS LIMITED WARRANTY

This Limited Warranty gives you specific legal rights. You also may have other legal rights that vary by state. Likewise, some of the limitations in this Limited Warranty may not apply in certain states. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights, you should refer to the laws applicable in your state and you may wish to contact a relevant consumer advisory service.

8. DISCLAIMER OF IMPLIED WARRANTIES

EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLUME DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLUME ALSO LIMITS THE DURATION OF APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.

9. LIMITATION OF DAMAGES

IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL PLUME BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT. PLUME’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER.
